New leadership, new programs for a new year! from the desk of Frank Lysiak This winter issue of Community Association Connection reflects our chapter’s transi- tion to the 2014 calendar year. Last year ended with two well-attended – and enjoy- able – events that took place in Rochester and Buffalo. Both featured trade shows and recognition programs of chapter members celebrating their 5, 10, 15, 20, 25, 30 and – would you believe? – 35-year anniversaries. On this page are photos of some of the members who attended. We held CAI-WNY’s annual meeting at the Buffalo event; we elected board members, shared the chapter’s achievements, and disclosed finances. According to outgoing President Ronald Shubert, we had a record number of attendees at programs, and the […]

Legal Corner

by Ronald S. Shubert, Esq. Q: At the annual meeting of our condominium board, two unit owners counted the votes and announced the results. After the meeting was adjourned, the property manager took the ballots and the paperwork back to her office. Without direction from the board, the property manager recounted the votes and came up with a different result. What is the status of the election? A: The answer depends on whether the vote counters on the night of the election were appointed inspectors of election or not. Inspectors of election are appointed by the board pursuant to the condominium bylaws and their job is to determine the eligibility of voters and validity of proxies, count the votes, and make a report of election […]

Here’s the legislation we’re watching in 2014

by Frank Lysiak, CMCA, AMS; Executive Director, New York State LAC New York State legislators began their 2014 session on January 8 and are scheduled to conclude on June 19. NYS-LAC will continue its efforts to gain support on key legislation that will have an impact on all of our communities, including:   Community Manager Licensing Bill (A4917): At a recent meeting of the NYS-LAC, a decision was made to switch our focus from the Assembly Bill # A4917 to an existing Senate Bill # 184 by Senator Daniel Squadron regarding an act to amend the real property law, in relation to licensing and proper accreditation of professional community association management. The reason for the change was the recent resignation of Assemblyman Dennis Gabryszak who […]
